“Ms. Heard and her friends then fabricated photos that she used to obtain an ex parte TRO [temporary restraining order] and a $7 million divorce settlement which Ms. Heard falsely testified in London she gave to the ACLU and, more scandalously, to the Children’s Hospital of Los Angeles; sick children with cancer,” Chew alleged in his filing. While Heard never mentioned Depp’s name in the 2019 Washington Post op-ed in question, he insists that the article was about him because Heard previously alleged that she suffered two black eyes, a broken nose and a broken lip at his hands during a 2015 attack in Los Angeles. Attorney Chew, however, claims that when the LAPD responded to the alleged beating, “they found no injury upon Ms. Heard and no disruption to the penthouses.

The acrimonious lawsuit between former spouses Johnny Depp and Amber Heard is set to go to court, and many famous names will testify.

UK defamation law famously requires the publisher to prove their statements (rather than the alleged injured party), and the case was brought to trial in which both Depp and Amber Heard testified. Following that case (and a failed appeal by Johnny Depp), the Dead Man actor sued Amber Heard for defamation after she published a lengthy op-ed about his alleged abuse in The Washington Post. At this point, Depp counter-accused Heard as an abuser. The current lawsuit in question is a $100 million defamation suit brought by Aquaman actor Amber Heard against Johnny Depp, which itself is in response to a $50 million defamation suit the Pirates of the Caribbean actor filed against Heard in 2019.

The actor asked the Court of Appeal to grant permission for him to challenge the ruling, with the aim of having its findings overturned and a retrial ordered, but the appeal was denied in March last year. The pair also met in the Royal Courts Of Justice in London in 2020 after Depp brought a libel against the publisher of The Sun for referring to him as a “wife-beater”. Depp and Heard started dating after meeting on the set of 2011 film The Rum Diary. They married in Los Angeles in February 2015.

Bettany's texts are part of Heard's evidence of Depp's abuse, but Bettany will be testifying on Depp's behalf in the actual trial, presumably to explain away the texts. The origin of the suit goes back to a December 2018 piece that Heard wrote in the Washington Post that alleged Depp was physically abusive toward Heard during the couple's brief, tumultuous marriage. After three years, the defamation lawsuit between actor Johnny Depp and ex-wife Amber Heard, over claims Heard made about abuse she suffered at the hands of Depp, might finally be getting ready for trial.
