The Stormy Daniels case won't stop Donald Trump (Spectator.co.uk)

The 45th president of the United States of America — and the leading Republican contender to win back the White House in 2024 — may or may not be arrested ...

President Trump’s great genius is for publicity — the grubbier the better — and he appears to be firing on all cylinders at the moment. He puts himself forward as the grown-up Trump, someone who is willing to hit the Democrats where it hurts, but isn’t drowning in sleazy allegations and online scuttlebutt. His ‘Truth’ was probably a reaction to DeSantis’s rather pointed response to the reports of Trump’s imminent arrest. Avenatti used to go on TV a lot to rant about the evils of Trumpism and was once hotly tipped to be a future presidential candidate. The whole Daniels saga is a strange one: the Southern District of New York used to call it the ‘zombie’ case. It seemed to have gone cold as New York prosecutors decided a better way to ‘get Trump’ – apparently a legitimate goal of the state’s judicial system – was through his opaque financial records.

Trump's team, as they have been when it comes to DeSantis, went on the attack. Chris Sununu, who is mulling a run for president and is no Trump fan, told CNN: "I think it's building a lot of sympathy for the former president." Essentially, it means — do something to provoke a response from your enemy. Since Saturday, there have been at least a dozen fundraising emails sent out in Trump's name about his impending "arrest" (plus about half a dozen more trying to shape the narrative). Alvin Bragg was displaying "an outrageous abuse of power" and said he was "directing relevant committees to immediately investigate if federal funds are being used to subvert our democracy by interfering in elections with politically motivated prosecutions." He noted that some Republicans, who aren't necessarily pro-Trump, "all said they felt like he was being attacked." PROTEST, TAKE OUR NATION BACK!" Donald Trump's Republican allies in the House are doing what the former president taught them to do -- use government power to try to keep his legal threats ...

The charges could rise to a felony if it could be proven that Trump tried to cover up the payment in order to commit another crime, which in this case could be a violation of campaign finance laws. And so the big question that I have with respect to New York is what has changed more recently in the past year or so that has gotten it to this point?” In an ideal world, someone who is indicted, as Trump could be in the coming days, has the opportunity to disprove a case they say is unfair and not supported by the evidence. The ex-president could be charged with a misdemeanor over allegedly improper classification in business records of a payment to Daniels, although hush money payments themselves aren’t illegal. The consequences of a failed prosecution against a former president would be profound and may deepen the country’s political polarization. Yet a feeling of uncertainty is also being exacerbated by a potential case against him that some legal experts warn is far from a sure-fire winner in court. But Trump and his allies are not waiting for that moment, and in the process, are offering a preview of the months of deepening political turmoil that a prosecution could entail – not just in Manhattan but in multiple other investigations against him. “And the tough part is with a local DA playing in presidential politics, if that starts right there, don’t you think it’ll happen across the country?” A source close to Trump’s legal team told CNN on Monday that they do not have any guidance on the timing of a potential indictment beyond that they been told by the DA that nothing is expected Tuesday. But any prosecution would also have to rebut arguments that Trump was being targeted simply because of who he is and was therefore not getting fair treatment. Hanging over everything is the mind-bending possibility that, for the first time ever, a former president could be indicted. This is an especially fateful issue given the gravity of any potential case against a former president.

Former US president Donald Trump is being investigated over alleged payments to adult actress Stormy Daniels in the run up to the 2016 election.

He would be the first US president to face criminal charges. Prosecutors may also allege that this breaks US election law, as his attempt to hide the payments to Ms Daniels were motivated by not wanting voters to know he had an affair with her. [Truth Social platform](https://truthsocial.com/) on Saturday, Donald Trump said he expected to be arrested on Tuesday (March 21) over alleged payments made shortly before the 2016 US election which saw him become president.

Law enforcement and security experts told CNN they are not seeing large groups animating around Trump’s Truth Social post calling for protest at any level near what they saw at January 6. Officials in Washington are preparing for demonstrations surrounding any indictment of Trump that could erupt into violence, a district official told CNN on Monday. A key difference two years after January 6, sources tell CNN, is the threat of arrest has risen in the minds of many potential protesters. Some posts from influential right-wing figures in recent days have seemingly been more geared at creating chaos than at sparking violence.

Fingerprints and a mugshot: What happens if Trump is arrested (BBC News)

Donald Trump claims he will be arrested on Tuesday on charges stemming from an investigation into a $130,000 payment to porn star Stormy Daniels in 2016.

If Mr Trump were convicted on the felony charge, he would face a maximum sentence of four years in prison, although some legal experts predict a fine is more probable, and that any time behind bars is highly unlikely. Mr Trump would then wait in a holding area or cell until his appearance before a judge. Once inside, however, Mr Trump will be fingerprinted and have his mug shot taken like all defendants in criminal cases. The decision on whether to file charges rests with New York City District Attorney Alvin Bragg. Prosecutors could also potentially allege that this breaks election law, because his attempt to hide his payments to Ms Daniels was motivated by not wanting voters to know he had an affair with her. However, when Mr Trump reimbursed Mr Cohen, the record for the payment says it was for legal fees.

Whenever he comes to New York, he and his attorney will report to the district attorney’s office where Trump will be arrested and booked, which means he’ll be finger-printed and have his mug shot taken. It is possible that he’ll be handcuffed when he is transported from the district attorney’s office to court — a short walk away within the same building. And then he’ll be released, because the charges he is likely to face are non-bailable. Because the case is white-collar, the district attorney’s office will ask Trump’s attorney when he plans to come to New York to be arraigned. Once the indictment is stamped, the district attorney’s office will notify an attorney for Trump that he has been indicted. In many ways, the mechanics of indicting Trump are likely to be the same as they would be for any other defendant charged by Manhattan District Attorney Alvin Bragg.

How Donald Trump is fundraising over his own 'arrest' prediction (The Independent)

The former president spawned a media frenzy after he predicted his arrest, and a fundraising campaign spinning a narrative of his political persecution ...

Last year, the panel’s senior investigative counsel Amanda Wick said Mr Trump’s campaign “pushed false election claims to fundraise, telling supporters it would be used to fight voter fraud that did not exist.” “A racist Soros-funded prosecutor is answering his puppet master’s call to take down our America First movement,” the message states. If you are doing well, which was made possible through the great policies of the Trump Administration, send your contribution,” wrote Mr Trump, adding a link to his website for donations. The email tells supporters that “you’re our country’s only hope.” His own team followed up to clarify that he did not receive any indications from prosecutors that he had yet been charged or would be imminently arrested. Another email from the Trump Save America Joint Fundraising Committee, the primary fundraising vehicle for his 2024 campaign and leadership political action committee, called on supporters to “make a contribution of any amount to show that you will never surrender as the witch hunts heat up like never before”.

Trump wants to be handcuffed for court appearance in Stormy ... (The Guardian)

People close to former president said to be unsure whether he is serious about wanting to do a perp walk.

But Trump has rejected that approach and told various allies over the weekend that he didn’t care if someone shot him – he would become “a martyr”. Trump later reimbursed Cohen with $35,000 checks using his personal funds, which were recorded as legal expenses to Cohen. Trump’s increasing insistence that he wants to be handcuffed behind his back for a perp walk appears to come from various motivations, including that he wants to project defiance in the face of what he sees as an unfair prosecution and that it would galvanize his base for his 2024 presidential campaign.

Mugshot, fingerprints, handcuffs? What is the process for indicting ... (The Independent)

Former president expects to be arrested this week. Mystery remains over how such an arrest could be carried out.

The crime(s) for which he could be indicted are not considered violent offences, and the former president is hardly considered an escape risk. For the initial booking procedure, yes; that cannot be done remotely. His lawyers have indicated that the former is the most likely outcome, should charges actually be handed down. District Attorney Alvin Bragg has also reportedly been discussing the optics of handling Mr Trump’s arraignment, so don’t expect any attention-grabbing moves like slapping Mr Trump in cuffs. Several questions remain about the step-by-step process for criminally indicting a former president, including the logistics of actually carrying out the task of bringing Mr Trump to the courtroom. In most cases of white collar crime, defence counsel works it out with the DA’s office and the two parties schedule a time for the defendant to come in.

That means that if Tacopina had information that contradicted Daniels’ testimony or undermined her credibility, he could not act as a witness for Trump while also being his lawyer. “He has to have critical testimony for the judge that the witness-advocate rule disqualifies him.” The ethics rules are designed to protect not only Daniels, but also Trump himself, said Fordham Law School professor Bruce Green, who directs the university’s Louis Stein Center for Law and Ethics. “I can’t really talk about my impressions or any conversations we’d had because there is an attorney-client privilege that attaches even to a consultation,” Tacopina said in the 2018 interview. It would be up to the prosecutors or Daniels to raise objections to him or his firm cross-examining her, according to Stephen Gillers, a New York University School of Law professor who has written extensively about legal ethics and rules. The impact that the disclosure will have on the case will depend on the circumstances and the substance of the communications, the ethics experts said.

Trump called for protesters. They turned up and demanded his arrest (The Independent)

Former president is reportedly on the brink of being indicted.

Mr Trump is facing the possible indictment in Manhattan as well as a number of other criminal and civil legal concerns related to his efforts to overturn the result of the 2020 election and his real estate dealings. If Mr Trump is indicted, as is expected, it will be the first time ever that an ex-president has been indicted for a crime. The grand jury reportedly hearing Mr Trump’s case is expected to return on Wednesday, possibly to vote on his indictment.

Trump Reportedly Wants To Turn His Arrest Into A 'Spectacle ... (Forbes)

Former President Donald Trump has told advisors he wants his potentially imminent arrest to be a public “spectacle” including handcuffs and a “perp walk” to ...

It’ll then probably take a while before his case goes to trial, as legal experts cited by [Reuters](https://www.reuters.com/world/us/donald-trump-could-be-charged-any-day-what-happens-next-2023-03-19/?utm_source=Sailthru&utm_medium=Newsletter&utm_campaign=Daily-Docket&utm_term=032023) noted Manhattan criminal cases typically take more than a year to go to trial—potentially setting Trump up to be convicted during the 2024 election. Trump allegedly reimbursed his ex-attorney Michael Cohen for the $130,000 in payments to Daniels, but labeled the payments as legal fees, and it’s expected prosecutors will charge Trump with falsifying business records as a result. In New York, that can be a felony if it’s used to cover up another crime—as prosecutors are expected to argue was the case here—and legal experts cited by [Insider](https://www.businessinsider.com/trump-risks-zero-to-4-years-jail-ny-hush-money-2023-1?r=US&IR=T) speculate Trump could face a prison sentence of up to four years if he’s convicted. The grand jury that will vote on his indictment will meet on Wednesday and more information about Trump’s indictment could come out after they meet, though it’s still unclear if they could vote then on whether he should be indicted. [Trump is arrested](https://www.forbes.com/sites/alisondurkee/2023/03/20/heres-what-will-happen-if-trump-is-arrested/?sh=f5dad6175d51), he’s expected to appear in person in Manhattan, where he would be fingerprinted and have his mugshot taken before being arraigned and pleading not guilty to the charges against him. If the jury does vote on Trump’s indictment, his arrest would not come immediately after, as prosecutors and Trump’s legal team would likely then have to arrange the logistics of his surrender. Trump’s desire for his arrest to be a “spectacle” appears to be because he wants to fire up his base and “project defiance,” the Guardian notes, reporting he’s “deeply anxious” that more muted proceedings would “make him look weak or like a loser.” Trump has told associates that he “wants to be handcuffed” when he’s arraigned in court after being indicted, the Guardian reports based on anonymous sources, noting the ex-president’s “increasing insistence that he wants to be handcuffed behind his back for a perp walk.”

Manhattan District Attorney Alvin Bragg is mulling whether to charge Trump with falsifying business records, after the Trump Organization allegedly reimbursed Cohen for the payment then logged the reimbursement as a legal expense, sources have told ABC News. The species exhibits “extreme polygyny”, in which a small proportion of the largest and most dominant males – known as beachmasters – control harems of breeding females. The Intergovernmental Panel on Climate Change published the “synthesis report” of its sixth assessment report (AR6) on Monday. They include restoring other degraded land, and stopping it being turned to agriculture, stopping deforestation, changing agriculture, and changing the way we eat. Eight years in preparation, this mammoth report encompasses the entire range of human knowledge of the climate system, compiled by hundreds of scientists from thousands of academic papers, and published in four parts, in August 2021, February and April 2022, and March 2023. Pittman’s plan was to place the buses on the land, transform one into a living space, and turn the other two into mobile salons. In a 52-page witness statement published yesterday, he wrote: “I accept that the House of Commons was misled by my statements that the rules and guidance had been followed completely at No 10. In 2022 there were more deaths than births in the Chinese capital, resulting in a natural population growth of minus 0.05 per 1,000 people. Ukrainian forces repelled Russian attempts to advance into the centre of the small eastern city of Bakhmut yesterday. He later added that if he got shot, he would probably win the presidency in 2024, the sources said. Trump told various allies over the weekend that he didn’t care if someone shot him – he would become “a martyr”. If the committee decides he “recklessly” misled MPs, he faces being suspended from parliament. But above all, people close to Trump said, he was deeply anxious that any special arrangements – such as making his first court appearance by video link or skulking into the courthouse – would make him look weak or like a loser.

As officers set up railings outside Trump Tower, former president told allies he welcomed prospect of being handcuffed to fire up supporters.

Friends of Mr Trump who have spent time with him in recent days claim he appears disconnected from the gravity of the charges he is facing. “He wants to be defiant - to show the world that if they can try to do this to him, they can do it to anyone,” one source close to Mr Trump told the newspaper. Allies of Mr Trump told the New York Times that he wanted the opportunity to demonstrate to the public he was not skulking away in shame.
